Sensitive data reveals your racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data, and data concerning health and sex life.

Is it legal to collect and process sensitive personal data?  In fact it is prohibited to collect/process sensitive data unless there is a very good reason. Legal reasons for its processing are listed below.

Explicit consent of the individual

Examples could be participation in clinical trials, activities conducted by the pharmaceutical sector.

For example, sick leave reporting is sensitive data and required to report as part of time reporting in the payment of salary

Assessment on ability to work

It is necessary for assessing the working capacity/capability of the employee.

It is public data

The data had previously been made public by the individual, e.g. in Facebook, a blog, article in the newspapers.

Police have requested the data

Police have requested the data.

Social security or/and tax laws

e.g. Sick leave is reported impacts how the salary is paid.

Establishment, exercise or defence of legal claims

It is necessary for the establishment, exercise or defence of legal claims
